Terms of Use

Effective September 30, 2026

  1. Scope and Acceptance

    These Terms of Use (“Terms”) apply to Pond, an operating system developed and operated by Butterfly Interaction, Inc. (“Butterfly,” “we,” “us,” or “our”), as well as our websites, documentation, community spaces, and other related services.

    By downloading, installing, accessing, or using Pond or our services, you agree to these Terms.

    If you do not agree to these Terms, please do not use Pond or our services.

  2. Pond Early Preview

    Pond is currently available as an Early Preview and is still under active development.

    Because this build is an early release, Pond may contain bugs, incomplete features, security issues, compatibility problems, crashes, or other unexpected behavior. Some features may not work as expected and may change or be removed as development continues.

    You are responsible for deciding whether Pond is appropriate for your device and intended use. We strongly recommend backing up important files and data before installing or using Pond.

    We may release Pond in batches and change its availability, system requirements, features, or builds during the preview period.

  3. Open-Source and Third-Party Software

    Pond includes open-source software as well as drivers, packages, libraries, and other components provided by third parties. Each component is governed by its own license, which determines your rights to use, copy, modify, or redistribute it.

    Nothing in these Terms limits any rights granted under an applicable open-source license.

    Butterfly retains all rights in Butterfly and Pond trademarks, logos, branding, designs, fonts, documentation, and other proprietary materials unless they are released under a separate license. Font files included with Pond may not be extracted, copied, or redistributed separately except as permitted by the applicable font license or law.

  4. Using Pond and Our Services

    You may use Pond and services provided specifically for Pond for lawful purposes.

    You must not use Pond or our infrastructure to:

    • break applicable laws or regulations;
    • introduce malware or other harmful code;
    • gain unauthorized access to systems, accounts, networks, or data;
    • intentionally damage, overload, or disrupt systems or services;
    • misuse, scrape, or abuse infrastructure operated by Butterfly;
    • impersonate Butterfly or its team members;
    • harass, threaten, or intentionally disrupt other community members; or
    • violate another person’s intellectual property, privacy, or other legal rights.

    You are responsible for the information and content you provide and must have the right to provide it.

  5. Community Spaces

    We operate community spaces on Discord, GitHub, and other channels or forums. Please interact respectfully and follow our Code of Conduct and community rules. We reserve the right to remove content or restrict access to our community spaces for misconduct, abuse, or rule violations. Being removed from a community space does not restrict rights granted to you under an open-source license.

  6. Feedback and Open-Source Contributions

    We welcome bug reports, feature requests, suggestions, comments, and other feedback about Pond (“Feedback”).

    By submitting Feedback, you give Butterfly permission to use, reproduce, analyze, modify, publish, and incorporate that Feedback into Pond and future products and services without restriction or compensation.

    Please only provide Feedback that you have the right to share.

    Code, documentation, patches, or other contributions submitted to Pond’s open-source repositories are governed by the license and contribution rules that apply to the relevant repository.

  7. Privacy Policy

    Our collection and use of personal information are described in the Pond Privacy Policy.

    If a Pond feature uses a service provided by another company, that company may process information as described in our Privacy Policy or in a notice shown with the feature.

    Please do not submit passwords, authentication credentials, highly sensitive personal information, confidential information belonging to others, or information that you do not have permission to provide.

  8. Early Preview Disclaimers and Limitation of Liability

    Pond is provided “as is” and “as available.”

    Because Pond is an Early Preview, we do not guarantee that it will be free from bugs or security issues, compatible with every device or driver, remain available without interruption, or preserve your files or data.

    To the maximum extent permitted by law, Butterfly Interaction, Inc. and its directors, officers, employees, contractors, contributors, licensors, and affiliates will not be responsible for losses arising from your installation or use of Pond, including data loss or corruption, system instability, software or hardware problems, service interruptions, or security incidents.

    Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

  9. Updates, Changes, and Availability

    We may update, modify, replace, suspend, or discontinue builds, features, services, documentation, or preview access at any time. Updates may add, change, disable, or remove functionality. We do not guarantee that Pond or its related services will always be available or supported. We may also update these Terms as Pond develops.

    Material changes will be posted through our website or official community channels and will show an updated date.

    Your continued use of Pond after updated Terms become effective means those updated Terms will apply to your continued use.

  10. Third-Party Services

    Pond may interact with or depend on services, software, websites, or other resources operated by third parties. Those services may have their own terms and privacy policies.

    Butterfly does not control these services and is not responsible for their availability, content, security, or practices.

  11. General Terms

    These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except where applicable law requires otherwise. If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

    If Butterfly does not enforce a provision of these Terms immediately, that does not mean we give up the right to enforce it later. These Terms do not create an employment, partnership, joint venture, agency, or similar relationship between you and Butterfly.
